Japanese developer of 'Winny' P2P program arrested

GristyMcFisty used our news submit to tell us that Japanese police have arrested the developer of Winny, a popular P2P application in Japan.  The charge was of breaking the country's copyright laws.  Isamu Kaneko (33) is the creator of the supposedly anonymous file sharing system, he was accused of developing software that aided copyright infringement and piracy. 

 

This is the first time a software developer has faced such allegations for creating such a piece of software.  The Winny application was developed to hide users behind anonymity and has proved popular inJapan since its launch in April 2002.  A document which has leaked onto the author's Winny P2P network, shows that the police arrested the author because it allowed a 41 year old and 19 year old to download movies and games illegally.  The site that offered the Winny P2P application was taken down last December by Police to stop anymore users using this service.

Kaneko is one of the first software developers worldwide to face such allegations.

Winny, which offers to shield users behind a "cloak of anonymity", has proved incredibly popular in Japan since the shareware utility was announced in April 2002. The application has become a focus of concern for authorities in Japan this year after investigation records from a Kyoto Prefecture Police officer"s computer and military files from Japan"s Self-Defence Force were made available across the Winny P2P network.Police said Kaneko was arrested because Winny allowed a 41-year-old man from Takasaki and 19-year-old from Matsuyama to illegally download pirated games and movies from the Internet, Japanese paper Mainichi Daily News reports. Police shut down a website offering the Winny application for download last December.

You can read the full story over at The Register .  It's unfair to arrest the author as who was he know that it as going to be used for illegal purposes.  It's like saying why not blame the car dealer when a driver hits someone with their car, the dealer didn't know that the driver was going to be wreckless.  Of course Japan is stricter about copyright as we can see, but blaming the author is unfair as he can be held responsible for other user's actions.
