RIAA gets slapped by the court.

Debbie Foster was sued by the RIAA in 2004 for downloads allegedly made by her adult daughter because the Internet account was in her name.  Even after they finally got the correct plaintiff, they would not drop Debbie from the suit.  The judge held that the RIAA was out of order and dismissed the case with prejudice, allowing for a recovery of court costs.  In July, the judge awarded Ms Foster over $68,000 in court costs but despite the judgment being entered, the RIAA has yet to pay and now Ms. Foster is seeking a $210,000 bond.

It looks as though this chapter will finally come to an end as the RIAA has said they intend to pay; they are just dragging their feet until the very last moment.  More and more individuals are fighting these cases when the letter comes from the RIAA, but there is no indication that they will stop anytime soon.  They seem to be perfectly content to spend thousands of dollars to collect just a few hundred.

They will continue until a judge makes them aware that the suits will no longer be tolerated and they are brought up on federal charges of extortion.

Why do you say that? Things are even worse in most of Europe. In Germany for example you get jail time. I've seen cases of people going away for five years. Murderers only get a maximum of 15 for chrissakes. That is just way out of proportion.

The RIAA won't be stopped until ALL consumers of RIAA products bring a country-wide class action suit to force them to cease and desist. Once the RIAA faces a battery of hundereds of lawyers and millions of litigants will they finally back off.
