U.S. may ask World Trade Organization to act on piracy in China

James Mendenhall, general counsel of the Office of the U.S. Trade Representative said in Beijing last week: that the United States may file a Complaint with the World trade organization, if Chinas government does not take affirmative action against violations of intellectual property.

China's government has to "dramatically reduce" violations of intellectual property or the United States will not hesitate to take China to a dispute settlement at the World Trade Organization, James Mendenhall, general counsel of the Office of the U.S. Trade Representative, said in Beijing.

"If we were to conclude that the dispute settlement is the best solution in dealing with China, we will not shy away from that," Mendenhall said during a lunch hosted by the U.S. business community in Beijing.

Mendenhall was in Beijing for three days of talks with Chinese officials over intellectual-property rights and other issues, including removing trade barriers to foreign auto parts. U.S. officials and lawmakers say rampant piracy is contributing to the nation's surging trade deficit with China.

The report went on to say that Microsoft claimed losing as much as $60 billion a year because of the abundance of fake goods worldwide. It was also reported that a staggering 90 percent of software used in China is pirated, according to researcher IDC and the Business Software Alliance (funded by Microsoft). They went on to say that DVD copies of Hollywood movies sell openly on the streets of Beijing and Shanghai for as little as $1 apiece.

Do the US Government really think that the Chinese Government gives a crap about pirated software? And as for the $60 billion lost, i think old Bill was using windows calculator for that one, it must have gave him a factor of 10 out, try $6 billion, 60 is way too much.
Dunno about the amount... I got my copy of Photoshop 7 for $3 in China, it's normally $700.

Piracy should be the least of the US concerns if human rights means as much as they claim it does (yet still gives China a Most Favored Nation status).
I find it laughable that the the US government made a complaint through the WTO, as the US government routinely ignores WTO rulings that don't go in their favor and the current administration breaks international treaties whenever it suits them. If they refuse to follow the rules, how can they expect anyone else to?

its always wierd how they measure lost sales by how many pirated copies they believe to be out there. When if its either a downloaded copy and costs 50 cents for the blank dvd or its a pirated copy and costs a few bux on the street, it still didn't cost the person 20 bux to buy it.

Therefore.. if there were no pirated copies, they wouldn't be selling 60 billion dollars worth of copies, because there wouldn't be the extra funds for people to buy them at actual legitimate prices.

I'd say if 60 billion dollars worth of dvd's were sold mesuring them at actual market value, they they probably on really lose a few hundred million in actual sales, because people don't actually have all that much money to buy alot of copies at actual cost.
i'll put it this way, if it wasnt for piracy, the computer market would not be as large as it is. If people dont have the money they just cant buy it, so they do with out, just like they did in the 80's. i wanted a computer in the worst WAY! but no money no computer! so if i had to pay for everything i would not be using a computer right now, i would be getting in trouble knocking over rich stores like walmart :-D

I have to agree with Crusty and Master. Nobody is going to move China. The words and deeds are cosmetic at best. The US better tread lightly before China cuts them off.

China only? Malaysia and the Philippines have DVD pirate plants too. Not only a dollar sometimes it's only 50 cents. ;)
Had it had no piracy, Bill would charge every user $1000 for WINXP.
